Supreme Court Deals Another Blow to Democracy

The Supreme Court has thrown out a nearly century old Montanna law barring corporations financing elections in that state. The court essentially voted as they had in the earlier “Citizens United” case which opened up the floodgates of corporate money to corrupt..erm…”Finance” elections.

And once again we see the conservative wing of the Supreme Court rule not on the points of law, or even the reality of what the law means, but on their politics.

Montanna had originally passed the law in 1912 in response to the abuses of the democratic process by copper barons and their money (and the politicians they were able to effectively buy). And now- a hundred years later, we are witnessing the same abuses- democracy, our country, and the lives and livelihoods of the american people for sale to the highest bidder.

And the hypocrisy is ironic- the conservatives, who have long trumpeted “States Rights” yet again go against that cornerstone of their beliefs when the rule of the state is something they disagree with, just as they have with everything from medical marijuana to gay marriage.

Justice Stephen Bryer, in writing a dissenting opinion, said it best- “casts grave doubt on the Court’s supposition that independent expenditures do not corrupt or appear to do so.” clearly taking a shot at Justice Kennedy’s majority opinion in “Citizens United” where he wrote: “we now conclude that independent expenditures, including those made by corporations, do not give rise to corruption or the appearance of corruption.”

Justice Ginsburg had also raised the specter that Citizens United decision was clearly leading to corruption back in Febuary, writing: “Montana’s experience, and experience elsewhere since this court’s decision inCitizens United v. Federal Election Commission, make it exceedingly difficult to maintain that independent expenditures by corporations ‘do not give rise to corruption or the appearance of corruption,’ ”

Make no mistake- the conservatives will be the death of America.

    SCOTUS approval ratings are down to the low 40’s. Their decisions over the last decade are all to the right, each a blow to democracy as we know it.

    • Yes, and it exemplifies yet another hypocrisy of the right – calling courts, such as the 9th circuit “activist courts” based not on the rule of law- but on how they view the opinion, while turning a blind eye to the same behaviour among the more conservative courts.
